Agreement to Terms

By accessing and using Magnimont's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these Terms of Service, please do not use our services.

Services Description

Magnimont provides web development, mobile application development, UI/UX design, and related digital services. Our services include but are not limited to:

• Custom web and mobile application development
• E-commerce solutions
• UI/UX design and consulting
• API development and integrations
• Marketing automation implementation
• Performance optimization and maintenance
• SEO and digital marketing services

User Obligations

When using our services, you agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your account credentials
• Not use our services for any illegal or unauthorized purpose
• Not interfere with or disrupt the services
• Not attempt to gain unauthorized access to any systems
• Comply with all applicable laws and regulations

Payment Terms

Payment terms are outlined in individual project agreements. General terms include:

• Fees are specified in the project proposal or contract
• Payment schedules vary based on project scope and timeline
• Late payments may incur additional fees
• Refunds are subject to the terms in the project agreement
• All fees are exclusive of taxes unless otherwise stated

Intellectual Property

Upon full payment, clients receive ownership of the final deliverables as specified in the project agreement. Magnimont retains ownership of pre-existing intellectual property, tools, frameworks, and methodologies used in the delivery of services. We reserve the right to showcase completed projects in our portfolio unless otherwise agreed in writing.

Project Timeline and Deliverables

Project timelines are estimates based on the scope defined at project initiation. Timelines may be adjusted due to scope changes, delayed client feedback, or unforeseen technical challenges. We commit to transparent communication regarding any timeline adjustments.

Revisions and Changes

The number of revisions included in a project is specified in the project agreement. Additional revisions beyond the agreed scope may incur additional charges. Significant scope changes will be addressed through a change order process.

Confidentiality

Both parties agree to maintain confidentiality of sensitive information shared during the course of the project. This includes business information, technical data, and proprietary methodologies. Confidentiality obligations survive the termination of the service agreement.

Warranties and Disclaimers

We warrant that services will be performed in a professional and workmanlike manner. However:

• Services are provided "as is" without warranty of any kind
• We do not guarantee specific results or outcomes
• We are not liable for third-party service failures
• Bug fixes are provided for a specified period post-launch

Limitation of Liability

To the maximum extent permitted by law, Magnimont shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the amount paid by the client for the specific service giving rise to the claim.

Termination

Either party may terminate a project agreement with written notice. Termination terms, including payment for work completed and return of materials, are specified in individual project agreements. We reserve the right to terminate services immediately for breach of these terms.

Dispute Resolution

Any disputes arising from these terms or our services shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes will be resolved through binding arbitration in accordance with applicable laws.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new terms on this page and updating the "Last updated" date. Continued use of our services after changes constitutes acceptance of the new terms.
